TERMS AND CONDITIONS
1. Order
The orders can be made:

- telephone
- via our on-line shop
2. FIELD OF APPLICATION
The general conditions apply by rights to any order recorded by Equilibrium SA. Unless otherwise stipulated written, any order implies that the customer agrees with our general conditions.
You will be sent an e-mail confirming receipt of your order. We reserve the right to decline any order. All orders are accepted subject to our Terms and Conditions of Sale.
3. PRICES
Our prices and our price-lists do not include the VAT (except postal charges for Switzerland
4. PAYMENT
The prices are based on a payment in cash; no discount for pre-payment is authorized. The freight costs and the VAT are charged to the buyer.
Payment conditions:
- Credit cards (via Pay-pal)
- By credit transfer on our account UBS
- by check in the order of Equilibrium SA
- With an invoice (only for recorded residents in
Switzerland
5. DELIVERY PERIOD
Except stipulated express, as a rule we send the goods the same day we receive the order and the payment. (Workdays). No price reduction or damage will be accepted if there is a delay in delivery. Postal fees are chargeable to the buyer. Any complaint concerning the delivery has to be made in three days from reception of the goods. Equilibrium SA reserves the right to proceed to partial deliveries implying partial sales.
6. COMPLAINT – GUARANTEE
For any complaint, please contact us to 41 (0) 21 806 22 45. Any return of product is subject to a demand of return, if not it will be refused and forwarded at the expense of the customer.
Any complaint about the delivery or the supplied goods has to be sent by registered mail within three days
The defective product must have returned at the expense of the customer to Equilibrium SA. The goods must be returned unused, unopened and in the same condition as they were originally despatched. However we undertake us to replace the defective product by a product with equivalent characteristics.
Any return of non defective product is subject to an invoice corresponding to the expenses (time, packaging and shipping).
Every unclaimed parcel at the post office within the normal delay will be returned to us. Unclaimed parcels can take up to 2 weeks to arrive back with us and customers will be liable to pay for despatching the order again. If customer decides to cancel an unclaimed parcel then admin charges will be deducted from the refund to cover shipping and payment handling costs.
7. RESPONSIBILITY and DISENGAGEMENT
In case of illness or of disease, please check first with a doctor or a heath professional in the way to evaluate your health condition adequately.
Neither Equilibrium SA, nor any of its directors, employees, or agents will be liable for damages of any kind arising out of or in connection with the bad use of these products, including compensatory, direct, indirect or consequential damages.
In no manner the comments and the information can be taken as a recommendation of treatment (preventive or curative), a prescription or a diagnosis nor must be considered as such.
Equilibrium SA cannot be considered as responsible for the consequences of the bad use of the products and for the possible damages caused to the user or to the third parties and cannot be the subject to any demands of damages.
8. NULLITY OF A CLAUSE
If the one or the other arrangement of these conditions is invalid or not applicable, all other capacities continue however to be applicable.
9. APPLICABLE RIGHT AND JURISDICTION
Above conditions are governed by the Swiss laws. Any dispute concerning the interpretation or the execution of the contract between you and Equilibrium SA finds from the exclusive competence jurisdiction of the courts located in Switzerland
10. PRIVACYPOLICY
The information you provide to Equilibrium SA is used only for identifying you and to get in touch with you at the need.
This information is used at no other end and in no way will be supplied to any third party.
